land referred to in this correspondence has up to this time been exercised unchallenged by the War Department. That these rights remained vested in the War Department has been recognized
by the Colonial Government until 17th November 1875 - though their attention has been several times specially drawn to the fact that the cession had not been completed.
I therefore respectfully maintain that no effective cession has taken place since the area, boundaries, and defined position of the thing (here, land) to be ceded, is unknown. All (except X which cannot be found) being transaction on paper, and not on the ground.
It is not to the interest of the War Department that the boundaries of their lands should be entirely undefined, as constant questions as to ownership and encroachments would probably arise and
extinguish that a valuable concession is granted to the Colonial Government, and as the initiative in laying out the new road to define the limits of their new acquisition lies with them. I respectfully submit that this should be done by actual measurement on the ground before the final cession can take place.
As the claims of the Chinese fishermen, as against the War Department, depend on the ownership of the land, these claims cannot be settled.
